For allegedly defrauding hundreds of thousands of “We Build the Wall” supporters by utilizing the money earned for personal purposes, Kolfage, Steve Bannon, and two others were charged with federal offenses in August 2020. According to the prosecutors, the individuals engaged in a conspiracy to channel $350,000 to Kolfage, “which he utilized to fund his extravagant lifestyle,” while “repeatedly telling donors” that Kolfage would not pay.

In May 2021, Kolfage was also charged separately with filing false tax returns and defrauding the IRS.
